SECTION A: Description of terms and phrases in this document
“us/our” - means SJ Agri LTD, staff and those working under our instructions “courier” - a company/network of companies who work under their own terms, instructions and requirements in order to carry out a delivery service on our behalf.
“In stock” - in stock is used on our website as a default result we are working to keep stocking information as current as possible
“your/you” - is meaning the customer, person who places the order or the point of contact.
“warrent/ warrented” - a term to determine liable party to any inadvertent damage or issues caused due to work we have completed or carried out.
SECTION B: WEBSITE TERMS OF USE
1. Our website and all its pictures and information is owned by us or our suppliers, no part of this website or our marketing property may be replicated without the express permission of either ourselves or of our suppliers or affiliated companies.
2. No access is given to the running or code of our computer systems or this website as per the rules of the computer misuse act 1990
3. the use of Fake information or false details is strictly prohibited and may result in your account being suspended or deleted with out notice or warning with no way to recover. Persistent offenders may well have their IP address blocked from access to our system.
4. Use of this website is free for use and world wide access is granted, all pricing is in GBP should you wish to pay directly in another Currency Please contact us for a manual invoice that can be given in EUROS with further currencies available on request.
5. Card payment services of provisioned by OPAYO a subsidiary of Elavon financial services. These are performed in an off server role meaning no card details or information is held, transferred or stored via our website/servers
6. use of logs and analytics, our website uses a number of cookies as agreed to in the cookie information and privacy policy, we use this data as per our privacy policy in order to assist us in building customer profiles including location, device and interested products. This data is used solely for our own purposes and is not sold or divulged to others except where third party apps may otherwise
7. We do not run a live stocking system and so the availability guide on our website is for guidance only, in the event of us not having a product we will where possible try to contact you regarding the status of your order. Should we not be able to provide the product as promised or in a suitable time frame then a full refund will be given. Cancelation later in to the order will be subject to our cancellation terms as described in section J.
8. As above SJ agri LTD does at times have stock shortages, should stock be unavailable through our suppliers or delivery delayed we accept NO responsibility for any increased costs of waiting incurred by customers and unless subject to special order terms Full refunds are welcome at any time before shipping as per cancellation terms in section J
9. Any data including usernames and passwords are entered at the users own risk, SJ agri LTD follows any guidance as per UK specific laws including adherence to GDPR regulations. Should you wish to know more please see our privacy policy.
SECTION C: National Delivery Terms
1. Deliveries are made nationwide via either pallet network, or via other parcel carrier; Small items are delivered through royal mail, with larger items via other parcel network. Where possible tracking information will be sent allowing you flexibility.
2. service speed, all deliveries are sent via economy services. This means that delivery times may be up to 3 working days from shipping, should additional delays be incurred SJ Agri LTD accept no responsibility for the package whilst in the hands of a third party.
3. It is YOUR responsibility to ensure any information or details regarding access or local road conditions are passed on. Any interruptions caused by lack of access or restrictions will result in additional charges being passed on.
4. Should delivery be failed or missed or refused then additional charges as informed in the delivery information document . Should you refute this then an investigation will be carried out by ourselves and the courier involved to determine fault and responsibility.
5. “untimed” an untimed delivery requires no notice and can come between the working hours this is the standard pricing for pallets, should timings or specific days be required then notice MUST be given and the correct service level selected upon ordering. This service speed is only valid for IN STOCK items and is only valid from point of hand over.
6. cancellations or returns are subject to our terms outlined in section J, it is YOUR responsibility to ensure products are returned as outlined in the aforementioned section J.
SECTION D: Local Delivery
1. Local Delivery means any delivery we deem to be suitable to be carried out by ourselves, we reserve the right during times of high workload to pass any previously locally delivered order on to our national service this will result in automatically application of Section C terms including delivery information regarding to national delivery.
2. We ‘SJ Agri LTD’ retain the right to refuse to enter any property we feel is not suitable for our vehicle or is deemed to be at a high risk of damage being caused, in this event the goods will be left ‘kerbside’ or at a location on the property where our vehicle is safe to access.
3. Drop off of goods, where possible we will use our pump truck and ramps to remove pallets from our vehicle, at the point the pallet has left our vehicle is when it is considered delivered. We will do our upmost to position your delivery where you wish but it must be understood this is not always possible and so you must be prepared to move. Where goods are smaller then we will either directly hand them to yourself as customer or leave them in a designated place along with a delivery note.
4. due to previous injuries and issues, SJ agri LTD, their drivers and any other staff reserve the right to refuse to place product in certain locations if ground conditions are deemed hazardous or risky or in accessible. Standard local delivery terms mean we will NOT move products further that 6FT from the vehicle except at drivers discretion.
5. Assistance with unloading, during unloading should you wish to assist it is always appreciated by all involved however at NO point should you ever mount one of our vehicles, this is to prevent risk of injury. Should help be given or not then standard drop off terms as described above will apply.
6. Any product damage incurred due to hand unloading products will only be compensated at our discretion depending upon person who caused damage. Should additional claim wish to be made this MUST be given in writing, your right to claim is VOID should compensation have been given such as additional product or refund processed.
7. Timings of deliveries are subject to our discretion we will always work to the best of our abilities around your specified times for a delivery however give no guarantee or promise of stated times. Should you be unable to meet a given delivery time your delivery may be pushed back several days during busy periods.
Section E: Services terms
1. services carried out by SJ Agri LTD including but not limited to our engineering department are subject to standard terms outlined in this section but may preclude examples as in other sections forementioned when required.
2. all service work is labour warranted for 3 months upon completion, should your machine not be used during this period then your warranty period will still be used.
3. warranty is strictly determined by ourselves and we have the right to retail any return to machine if issues raised are caused by user error or is caused by something unconnected to the work carried out.
4. description of work carried out is included on the invoice of every service invoice sent, Sj agri ltd are looking at further systems to help both themselves and customers complete and more seamless understanding of the work completed on their equipment.
5. Location of work, work can be carried out on location or in our workshop where on site work is not possible, should work be required to be carried out in our workshop then it is the customers responsibility to collect and drop of the machine. Work carried out on site will be subject to dynamic risk assessment carried out by engineer in attendance.
6. Our engineers have the right to refuse to work on any machine that is in a dangerous position or dangerous location, SJ agri ltd follow a STAY SAFE requirement and so will stand by any staff member who feels the job site is unsuitable. We do however understand that not every site is a workshop and so engineers are trained to assess given risks to ensure the maximum amount of jobs can be completed.
7. site requirements, when working on third party sites it may be necessary for third party safety rules to be carried out, these should be communicated to SJ Agri LTD before an engineer arrives on site so as to ensure maximum compliance. Full generic risk assessments are available and Dynamic risk assessments are present in vehicles to ensure full compliance.
8. Mileage charges are added to all jobs out on site, mileage is charged as a from ‘base’ charge, current ‘base’ is available as a post code on request, mileage is round down to nearest mile based on shortest route, mileage is charged each way accept at our discretion and jobs requiring multiple visits are charged as an amalgamation of all visits except where by multiple visits is our fault or our discretion. i.e. an incorrect part, a non diagnosed fault.
9. consumable charges, consumable charges are added to every job, in the event of large jobs then multiple consumable charges may be levied this covers all non specific components and may not represent the actual value used.
10. fixed prices services, a fixed price service is inclusive of all stated within the service description these services are subject to the standard terms and conditions, normally a fixed price service will require prepayment except at the discretion of SJ agri LTD.
11. call out/out of hours: SJ Agri LTD can operate 24 hours a day,7 days a week however, should we receive a call after 6pm or before 7am then it is the discretion of ourselves as to whether we attend immediately where possible or if any additional charges are liable.
12. lead times, during times of high workload a priority is given to breakdowns to ensure minimal downtime for customers, this can result in longer wait times or even cancellation of non essential work. We apologise if this causes inconvenience however hope most customers can appreciate the benefit this gives. 13. parts wait times, we have a range of direct parts suppliers meaning we are able to competitively price against any major dealer or organization on parts, as such however it may result in slightly longer wait times due to levels of stock held.
Section F: provision of parts and liability
1. parts provided are subject to customer preference of pattern parts or genuine components, where customers select pattern parts these will be secured through one of our suppliers.
2. if incorrect parts are supplied by ourselves then no charges are given on those parts and correct part is supplied, except as outlined in part 3 of this section.
3. incorrectly supplied parts due to customer mis ordering will be subject to customer issue an industry standard 25% restocking charge may be incurred on all parts returned with refusal to refund on any part not in a saleable condition. This is consistent with rules outlined in section G.
4. parts warranty are subject to warranties provided by manufactures, this may be anything from 0 to 3 years depending on component and manufacture terms, for further information on any part provided please contact
5. parts provided for delivery are subject to our standard delivery terms as outlined in this document in section C and Section D with parts provided with services liable to additional terms in section E.
6. parts returned for any other reason bar those aforementioned are subject to Section G
Section G: Returns of products
1. All products are subject to a 25% restocking fee, this is providing products are returned in a saleable condition, this may at our discretion be voided subject to reason of return.
2. Return of goods is the responsibility of the customer, including any costs associated with return, regardless of condition. Return address is available from us so please ensure communication is given before hand to ensure returns are shipped to correct location.
3. Returns are subject to distance selling guidelines under uk law except where these terms explicitly deviate agreed upon completion of an order involving accepting these terms.
4. any return required due to damage will have to have all damage provided to us in images prior to return to protect both yourself and SJ Agri LTD failure to do so may result in the previous mentioned stocking charge being applied.
5. any product must have any damage spotted notified to us upon arrival, this should also be notified with delivery driver/company where applicable. Failure to do so will result in any claim being rejected.
6. All items must be returned clean and in suitable/original packaging for any refund, returns are not accepted after 30 days from received date, we also reserve the right to offer a refund in terms of store credit where we feel necessary.
7. certain products due to safety reasons or logistical issues are not able to be returned. Products are notified before purchase within the description, in these circumstances your rights to return are void.
8. refunds are not processed until goods are confirmed with us and are Your responsibility until this point.
Section H: Worldwide Shipping and Availability
1. shipping prices listed on the website are uk mainland specific only, in the event of purchasing from a none uk mainland location, then additional charges may be requested subject to shipping costs.
2. SJ Agri LTD are uk Vat registered should you feel your purchase is not liable for UK VAT in the case of an overseas purchase then please contact us regarding a manual zero rate invoice,
3. Returns globally are as section G, it is buyers responsibility to cover all import costs and documentation.
4. Invoices can be given in local currency and can be paid into our range of currency accounts which can be beneficial to the customer in avoiding costly conversion fees. Please contact to request this.
5. products available worldwide are dependant on local laws and import requirements, Sj agri LTD accept no responsibility should any product be confiscated or refused due to customs requirements in the local country.
6. Any import tariffs or additional fees are subject to cost of the buyer, SJ agri LTD will not accept responsibility for these charges and no refund will be given.
Section I: Payment Terms and Options
1. payments via the website are via Card ONLY, this is as mentioned previously and ran by OPAYO a subsidiary of elavon financial services.
2. payments are available via bacs, details of our GBP Uk account is included on all manual invoices, for alternative accounts or for international transactions please contact us
3. all products and certain fixed price services are payable before product is delivered or service carried out.
4. failure to pay within allotted time will result in goods being held or further debt collection formalities in situations where goods or services have been delivered.
5. at times of large waiting list a failure to pay for your invoice, when awaiting products may result in your goods being sold to another waiting customer, we wholly reserve the right to do this and no rights of delivery or provision of goods are granted until full payment is completed
6. credit terms are available subject to approval and at the discretion of SJ Agri LTD. These may be offered to trade customers and are subject to an application form.
Section J: Cancellation Procedure
1. all cancellation must be completed in writing through either the website options or through an email, before shipping and on non special order items a full refund is available.
2. cancellations made after shipping will be subject to additional charges to cover shipping costs incurred. This value is the discretion of SJ Agri ltd and will be based on the costs incurred by ourselves.
3. cancellation of service, any service cancelled will be free of charge unless cancellation has resulted in costs being incurred, such as products ordered or travel carried out. Also in the case of an initial visit being completed but suggested works not being complete then costs will be incurred and an invoice raised.
Section K: Application of VAT
1. SJ Agri LTD is a registered company in the UK (england and wales) 09193665 and as such is VAT registered GB198941341. All products sold by us are therefore subject to VAT at the uk rate. Should you believe you are entitled to provision at ZERO rate please contact.
2. SJ Agri LTD sells a variety of products at different levels of Vat should we have made a mistake in the correct provision of VAT for product please don’t hesitate in letting us know.
3. Some products vary in vat rate depending on use, in these circumstances it is Your responsibility to ensure your purchase at the correct rate, (by selecting correct product). This is as per government guidelines on the product.
